UNINSURED ORGANISATION
LISTING SERVICE AGREEMENT

NOTE: PLEASE READ THIS AGREEMENT CAREFULLY BEFORE SUBMITTING YOUR AGREEMENT.

THIS AGREEMENT IS AS FOLLOWS:

1. Status of organisation
The organisation agrees -
(1) it is a community organisation; and
(2) if requested, it will give to VQ reasonable proof that it is a community organisation.
Note: For meaning of community organisation, see section 8 of agreement.

2. Insurance advice
The organisation agrees that all volunteers accessing our information on VQ’s website will be advised that this organisation does not maintain Public Liability or Personal Accident Insurance for volunteer workers and that the volunteer would be engaging with our organisation at his/her own risk

3. No Partnership or Agency
The organisation agrees -
(1) not to represent itself, and to use its best endeavours to ensure that its officers, employees, agents and sub-contractors do not represent themselves, as being an officer, employee, partner or agent of VQ or is otherwise able to bind or represent VQ;
(2) it is not, by virtue of this agreement, an officer, employee, partner or agent of VQ, nor does the organisation have any power or authority to bind or represent VQ;
(3) that nothing in this agreement shall create a partnership, agency or joint venture between VQ and the organisation, and neither party shall enter into or have authority to enter into any engagement or make any representation or warranty on behalf of or pledge the credit of or otherwise bind or oblige the other party.

4. Independent organisation
The organisation agrees –
(1) it is an independent organisation responsible for its own actions and not an agent of VQ;
(2) VQ is not responsible for the operations of the organisation or conduct of a potential volunteer or a volunteer working at the organisation’s work place.

5. What VQ is, and is not, responsible for
(1) VQ agrees it is responsible for providing the following information to a prospective volunteer -
(a) the details registered on the organisation’s Organisation Registration Form;
(2) The organisation agrees that VQ is not responsible for –
(a) checking or validating the information given to VQ by a prospective volunteer about the volunteer’s attributes and skills;
(b) deciding if a prospective volunteer has the appropriate attributes and skills or is a fit and proper person to be engaged in work by the organisation;
(c) supervising the work, monitoring the conduct, and ensuring the health, safety, and welfare of a volunteer working at the organisation’s workplace.

6. What the organisation is responsible for
The organisation agrees it is responsible for –
(1) deciding if a prospective volunteer has the appropriate attributes and skills and is a fit and proper person to be engaged in work by the organisation; and
(2) supervising the work, monitoring the conduct and ensuring the health, safety and welfare of a volunteer working at the organisation’s workplace; and
(3) entering into a proper agreement with a prospective volunteer before the volunteer starts work at the organisation’s work place.

7. Agreement taking effect
The organisation agrees this agreement has no effect until–
(1) it is submitted electronically by the organisation; and
(2) the registration application has been approved by VQ.

8. Definitions
In this agreement –
“community organisation” means any of the following that organises the doing of community work by volunteers –
(a) a corporation;
(b) a trustee acting in the capacity of trustee;
(c) a church or other religious group;
(d) a registered political party as defined under the Electoral Act 1992 or the Commonwealth Electoral Act 1918 (Commonwealth);
(e) the Crown (within the meaning of the Crown Proceedings Act 1980);
(f) a local government;
(g) any public authority constituted under an Act.
“community work” means work that is not for private financial gain and that is done for a charitable, benevolent, philanthropic, sporting, recreational, educational or cultural purpose.
“organised” includes directed or supervised.
“volunteer” means a person who does community work on a voluntary basis.
“work” includes any activity.

9. Uninsured Organisational Disclaimer

By participating in the VQ Uninsured Organisation Listing Service (“Listing Service”) you agree that in so doing to the greatest extent that may be permitted at law that VQ shall have no liability whatsoever to you as a result of making known to you the existence of one or more individuals whose skills and personal aspirations may be considered by you to be appropriate for your organisational needs. You accordingly acknowledge that in electing to take on the volunteer services of one or more individuals introduced to you in the Listing Service program that you have done so only after independently making your own enquires and assessment as to whether the skills and background of any such individual are appropriate for the needs of your organisation.
